All activities related to and performed through Avtar site shall be governed by the present General Terms and Conditions. Unless Avtar expressly accepts anything alternate in writing, the present terms and conditions supersede all other terms and conditions in the event of a conflict.
User is not permitted to use Avtar’s Site or its content, mark or any proprietary material of Avtar. Copying or downloading or recreating or sharing passwords or sublicensing or sharing in any manner which is not in accordance with these terms, is a misuse of the site or service or product and Avtar reserves its rights to act in such manner as to protect its loss of revenue or reputation or claim damages including stopping your service or access and reporting to relevant authorities. In the event you are found to be copying or misusing or transmitting or crawling any data or photographs or graphics or any information available on Avtar site for any purpose other than that being a bonafide purpose, we reserve the right to take such action that we deem fit including stopping access and claiming damages
The user further represent that you are not purchasing the products/services for resale to others and will not do so without Avtar’s prior written consent.
The user represents that he/she is not a minor and is not under any legal or other disability which limits his/her ability to comply with these Terms or to install and use the services subscribed and purchased with minimal risk of harm to you or others.
The user undertakes that the data/information provided by him is true and correct in all respects. The User shall certify that the information/data supplied by it to Avtar is accurate and correct.
By opting for this service the User are agreeing to receive details of Jobs from Avtar on your mobile, till the tenure of the service.
The user undertakes that he/she will not disseminate false/objectionable/ offensive material using these services.
Avtar would not be held liable for loss of any data technical or otherwise, and particulars supplied by subscribers due to reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond Avtar's reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
Avtar may make available Job Ads advertising employment opportunities and other job-related content, including links to third-party websites. Job Ads are created and provided by third parties over whom Avtar exercises no control; you acknowledge and understand that Avtar has no control over the content of Job Ads, links to or from Job Ads, or any conditions third parties might impose once a Job Seeker has submitted an application or left the Site.
We cannot confirm the accuracy or completeness of any Job Ad or other information submitted by any Employer or other user, including the identity of such Employer or other user. Avtar assumes no responsibility, and disclaims all liability for the content, accuracy, completeness, legality, reliability, or availability of any Job Ads, Company Pages, screener questions and responses, and assessments. Avtar does not guarantee the validity of a job offer and cautions Job Seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations. Job Seekers are solely responsible for verifying the accuracy of any Employer or job offer.
When the User search for jobs on the Site and proceed to apply for a job, including jobs on third party sites, Avtar may suggest information from your profile to include in your application. It is your responsibility to review suggestions before accepting them and including them on your application.
Avtar assumes no responsibility and disclaims all liability for the resume or application information you post, send or receive through the Site.
Once you provide information to an Employer, Avtar does not have control over the Employer’s use or disclosure of that information.. To maintain the quality of the Site and Services, Avtar in its sole discretion may impose limits on your ability to apply to Job Listings or to other Avtar services. When you ask Avtar to transmit an application or a message, or store such application, Avtar reserves the right to reformat such application or message.
Job Ads may expire between the time you submit your application and from the time it is received. Avtar has no responsibility for expired Job Ads or for delivering applications prior to a Job Ad’s expiration.
Avtar would not be held liable for loss of any data technical or otherwise, or of the resume/ insertion or information/data or particulars supplied by user due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond Avtar’s reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, distributed denial of service attacks, virus attacks, war and natural calamities.
Avtar offers neither guarantee nor warranties that there would be a satisfactory response or any response at all once the resume is put on display.
Avtar reserves its right to reject and delete any resume/ insertion or information/data fed in by the user without assigning any reason. Avtar has the right to make all such modifications/editing of resume in order to fit resume in its database.
It shall be the sole responsibility of the user to ensure that he uses the privacy setting options as he deems fit to debar / refuse access of the data fed by him, to such corporate entities individuals or consultants. Avtar shall not be responsible for such insertions / data being accessed by its subscribers or users whose access has not been specifically blocked /debarred by the user while using the privacy settings.
Avtar may determine what these recommended jobs are on the basis of a variety of factors, including but not limited to, any information you input on the Site about yourself searches you run on the Site, jobs you click on, jobs you apply to, or the materials you provide in a job application to an Employer through Avtar.
Avtar may use your application materials to determine whether you may be interested in a Job Listing, and Avtar may reach out to you about such Job Listing. Avtar may store such information regardless of whether a Job Listing has been closed or is no longer available on the Site
When you apply to a job using Avtar Apply, Avtar will attempt to send your application to the contact information provided to us by an Employer or their Agent. We cannot guarantee that such messages and applications will be delivered, received, accessed, read or acted upon
If the User leaves the Avtar Site and choose to enter a third-party website, the User’s accept any terms and conditions imposed by that third-party. Avtar has no obligation to screen any Job Ads, or to include any Job Ads in its search results or other listings, and may exclude or remove any Job Ads from the Site for any or no reason. Links to other sites through Avtar is not an endorsement of the contents of the same, if You chose to access these websites you do so at your own risk.
By using Avtar, the User agree that Avtar is not responsible for the content of the Employer’s job application, messages, screener questions, skills assessments or their format or method of delivery, and that Avtar does not guarantee receipt of your application by the Employer, or your receipt of messages from the Employer.
The user may receive messages, including but not limited to text messages, emails or email notifications corresponding with your or an Employer’s (in the event the User applied for a job) activity on or use of the Site. Messages or notifications are provided solely as a courtesy, and you should not rely on them. Avtar cannot vouch for the technical capabilities of any third parties to receive such text messages. Avtar disclaims all warranties with regards to the transmission or storage of such courtesy notices, does not guarantee their delivery or receipt, and does not guarantee the date or time at which they may be sent.
Any actions taken by an employer/recruiter on the basis of the background check report or otherwise, is the employer's/recruiter's responsibility alone and Avtar will not be liable in any manner for the consequences of such action taken by the user
Wherever applicable, user shall pay Avtar's fees under the payment terms mentioned in the specific conditions. All fees are calculated according to the rate in effect at Avtar, plus applicable taxes. All payments shall be in advance, except as agreed otherwise in writing. The payment for service once subscribed to by the subscriber is not refundable and any amount paid shall stand appropriated. Any sum paid to Avtar is not transferable. All delayed payments shall carry interest @ 18% per annum, payable from the date of due.
Avtar is not liable to the Client for any damage, loss, expenses, disputes or spending suffered or incurred by the user in connection with the use of the site. The liability, if any, of Avtar is limited to the extent of the amount paid by the User
Avtar shall use its best efforts to honour the agreement but refrains from a commitment to deliver the anticipated result.
This Agreement and any dispute arising out of or in connection with this Agreement or related in any way to the Site (“Dispute”) will be governed as to all matters, including, but not limited to the validity, construction and performance of this Agreement, by and under the laws of India. Any and all actions, lawsuits, or other legal proceedings related to such Dispute shall be filed exclusively in courts located in Chennai.
Avtar reserves the right to modify these terms any time, without prior notice.
